Privacy Policy for classcon.ph

classcon.ph ("we", "us", or "our") is the Personal Information Controller, as defined under the Philippine Data Privacy Act of 2012 (Republic Act No. 10173, or "DPA"), for the personal data we collect through our website, services, and applications (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect that information, and what rights you have over it. Please read it carefully.

1. Information We Collect

a. Personal Information

  • Identity & Contact Information: Your first and last name, email address, and password when you register for an account.
  • Profile Information: Your profile picture, display name, and other information you choose to provide.
  • Technical Information: Your IP address and information about your device and browser.

b. Sensitive Personal Information

Under the DPA, records related to a person's education are classified as Sensitive Personal Information, which we handle with additional care. This includes:

  • Educational Content: Classes, tests, questions, and other materials you create or that are created for you.
  • Exam and Assessment Records: Your responses to questions, scores, grades, and time spent on assessments, including a full record of your questions and answers (qna).

c. Exam Integrity Information

To detect and prevent cheating during timed exams (for example, tab-switching or use of multiple devices), we may collect your IP address, device/browser information, and approximate location while you are actively taking an exam.

d. Usage Data

  • Activity Information: Information about your activity on the Service, such as when you log in, the pages you visit, and the features you use, including timestamps for account creation, login, and updates.

e. AI Feature Data

If AI-assisted content generation is used on your class, either through a teacher's own third-party API key ("bring your own key") or through an AI service we may offer directly, the class materials relevant to that request are processed by the applicable AI provider (which may include OpenAI, Anthropic, Google, Opencode, or a provider we select ourselves) to generate a response.

2. Legal Basis for Processing

We process your Personal Information on the basis of the consent you give when you register or are enrolled in a class, and as necessary to provide the Service you have signed up for (DPA Sec. 12).

We process Sensitive Personal Information, such as grades and exam records, on the basis of your (or, for a minor, your parent's or guardian's) consent given at enrollment, and because such processing is necessary to fulfill the core educational purpose of the Service, consistent with existing laws and regulations governing school recordkeeping (DPA Sec. 13).

3. How We Use Your Information

We use the information we collect to:

  • Create and manage your account.
  • Provide, operate, and maintain the Service.
  • Personalize your experience on the Service.
  • Enable communication between users (e.g., teachers and students).
  • Administer and grade tests and exams, and safeguard exam integrity.
  • Monitor and analyze usage and trends to improve the Service.
  • Communicate with you, including sending you emails about your account, password resets, or invitations.
  • Protect the security and integrity of our Service.

4. How We Share Your Information

We may share information we have collected about you in the following situations:

  • With Other Users: Depending on your role, we may share your information with other users. For example, teachers may see the names and exam results of students in their own classes.

  • With Service Providers: We work with third-party providers who process data on our behalf, including:

    • Cloud hosting and database infrastructure.
    • File and media storage for uploaded materials.
    • Email delivery for account and notification messages.
    • Google, if you choose to sign in with your Google account.
    • An AI provider (which may include OpenAI, Anthropic, Google, Opencode, or a provider we select ourselves), only when AI-assisted content generation is used on your class.

    These providers are only permitted to process your information to perform services for us (or, for a teacher's own AI provider key, at the teacher's direction) and are not permitted to use it for their own purposes.

  • For Legal Reasons: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

  • To Protect Rights: We may disclose your information to protect our rights, property, and safety, as well as the rights, property, and safety of our users and others.

We do not sell your personal information to third parties.

5. International Data Transfers

Some of the service providers listed above may process or store data on servers located outside the Philippines. When this occurs, we remain accountable for your personal data in accordance with the DPA, and we take steps to ensure it continues to receive an adequate level of protection.

6. Data Security

We use administrative, technical, and physical security measures to help protect your personal information, including hashed (not plaintext) account passwords and AES-256 encryption for any AI provider API keys you choose to store with us. While we take reasonable steps to secure your information, no method of transmission or storage can be guaranteed to be 100% secure.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. When you or your school administrator deletes a record, it is first marked for deletion and excluded from normal use, then permanently removed in accordance with our internal data management procedures, unless a longer retention period is required or permitted by law.

8. Your Rights as a Data Subject

Under the Data Privacy Act, you have the right to:

  • Be informed that your personal data will be, are being, or have been processed.
  • Object to the processing of your personal data.
  • Access your personal data that we hold.
  • Request correction of inaccurate or outdated personal data.
  • Request erasure or blocking of your personal data under certain conditions.
  • Data portability, where technically feasible.
  • Be indemnified for damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal data.
  • File a complaint with the National Privacy Commission (NPC) if you believe your rights under the DPA have been violated.

9. Minors' Privacy

Our Service is intended for use consistent with the eligibility requirements in our Terms of Use. Where an account is created for or by a minor, we require the consent of a parent or guardian, or the school acting on their behalf as part of the enrollment process. If we become aware that a minor's personal data was collected without the required consent, we will take steps to address it, which may include deleting that information.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date.
